September 25, 2007 Regular Meeting Minutes
On Tuesday, September 25, 2007, the Council of the Rural Municipality
of Gilbert Plains met at 9:00 a.m. in the Council Chambers of
the Rural Municipality of Gilbert Plains municipal office.

1} Call meeting to order
Resolution #205-07 Bassett/Basaraba
Be it resolved that Reeve Malowski calls this meeting to order
at 9:05 a.m. Carried.
2} Additions to/Adoption of Agenda.
Resolution #206-07 Bates/Rehirchuk
Be it resolved that Council adopts the agenda of this meeting
as amended. Carried.
3} Adopt Minutes
Resolution #207-07 Rehirchuk/Bassett
Be it resolved that Council adopts the minutes of the regular
meeting held on September 11, 2007 as presented. Carried.

10:00 am Public Hearing
Resolution #208-07 Bassett/Basaraba
Be it resolved that Council hereby adjourns from this regular
meeting for the purpose of conducting a Public Hearing relating
to the 2007 budget and the purchase of a tractor. Carried.
No objections were presented.
Resolution #209-07 Rehirchuk/Bates
Whereas Council has heard any and all presentations regarding
the change to the 2007 capital budget; Therefore be it resolved
that Council hereby concludes the Public Hearing and return to
the order of business of this regular council meeting. Carried.
10:30 am Dick Mennon, Manitoba Water Services Board attended
the meeting to discuss potential rural water expansion plans and
the concept of a regional water system.
6} Committee Reports
Environmental Health Services – Nuisance Grounds
Councillor Basaraba advised that the position of Waste Disposal
Grounds Operator has been awarded to Dale Wehnan to begin work
October 2, 2007.
Economic Development Board
Councillor Basaraba reported that the Board has received a Provincial
grant in the amount of $6,000 to conduct a feasibility study regarding
a mobile slaughter facility.
Handivan
Reeve Malowski advised Council the Board has agreed to purchase
one van at an approximate cost of $75,000. He further advised
that the Fall Supper fundraiser will be held in Gilbert Plains
on October 21, 2007.
Sunset Lodge
Councillor Safronetz provided a verbal report on his attendance
at the Board meeting held on September 19, 2007.

Be it resolved that Council hereby adjourns until 1:15 p.m. Carried.
7} Accounts & Finance
Resolution #211-07 Bassett/Bates
Be it resolved that Council approve the expenditures in the following
amounts, as per the list of accounts:
General Operating $101,202.68 for cheques #2233 to #2265
Utility $3,118.02 for cheques #694 to #705. Carried.
8} By-laws
Resolution #212-07 Safronetz/Rehirchuk
Be it resolved that Council give third and final reading to By-law
#2007-07, being a by-law for the protection and maintenance of
undeveloped road allowances. Carried.

9} General Business
Resolution #213-07 Bassett/Basaraba
Whereas Section 326 of the Municipal Act provides for the imposition
of supplementing taxes; And whereas the Assessment Branch has
prepared a list of additions and reductions to be made to the
respective tax roll for 2007; Therefore be it resolved that the
tax listing identified in Schedule A in the amount of $6,987.41
be hereby added and the amount of $7,775.84 be hereby cancelled.
Carried.
Resolution #214-07 Safronetz/Rehirchuk
Be it resolved that Council authorizes Councillor Basaraba and
the Administrative Assistant to attend the Board of Revision seminar
being held in Dauphin, October 2, 2007. Carried.
Councillor Basaraba declared a conflict of interest with the
next business item as it relates to a direct pecuniary interest
and left the Council Chambers prior to discussion on the next
item.
Resolution #215-07 Bates/Rehirchuk
Be it resolved that Council hereby adjourns from the order of
business to move in camera.
Council held a discussion regarding a legal matter.
Resolution #216-07 Bassett/Safronetz
Be it resolved that Council hereby reconvenes the public meeting
and returns to the order of business and furthermore resolved
that the matter discussed in camera shall be kept confidential
until otherwise decided by Council. Carried.
Resolution #217-07 Rehirchuk/Bates
Whereas a) Councillor Basaraba has submitted an invoice to the
R.M. of Gilbert Plains for payment of material from property owned
by him; and
b) these expenditures were not authorized by Council; and
c) Council has received a legal opinion regarding this matter;
and
d) it has been identified that Councillor Basaraba has contravened
Section 16 of the Municipal Council Conflict of Interest Act.
Therefore be it resolved that a) Council hereby denies payment
of said invoice; and
b) Councillor Basaraba be restricted from holding the position
of Public Works Coordinator. Carried.
Councillor Basaraba returned to the Council Chambers for the
next order of business.
Resolution #218-07 Bates/Rehirchuk
Be it resolved that Council authorize a grant in the amount of
$800.00 to the Gilbert Plains Band for 2007. Carried.
Ward Business
Council reviewed and approved Work Orders #07-44 to #07-47
Council discussed the removal of municipal access within CN right-of-way,
as per Manitoba Highway Traffic Board Hearing directives, and
directed Councillor Basaraba to confirm funding from CN and design
features with Manitoba Highways so work can be completed in October.
Rural Water Business
Resolution #219-07 Safronetz/Basaraba
Whereas the Manitoba Water Services Board (MWSB) is considering
the feasibility of a regional water system for the supply of water
to the surrounding municipalities of the Towns of Gilbert Plains
and Grandview and the RMs of Dauphin and Grandview using the RM
of Gilbert Plains Water Treatment Plant as the source of water;
Therefore be it resolved that Council of the R.M. of Gilbert Plains
sign a Memorandum of Understanding with the MWSB to conduct a
study and further be it resolved that all costs for the said study
be borne by the above noted municipalities (excluding the R.M.
of Gilbert Plains) and the MWSB. Carried.
CAO advised Council of correspondence received from Manitoba
Water Stewardship Office of Drinking Water regarding a drinking
water regulatory update requiring the application for renewal
of the operating license to be made by September 1, 2008 and a
five year engineering assessment of the water system’s infrastructure
be completed by September 1, 2009.
